What could a consumer recover?

Federal law supplies possible remedies, but recovery depends on proof, defenses, court rulings, and the facts of each communication.

$500 and $1,500 explained

The TCPA authorizes actual monetary loss or $500 per violation, whichever is greater. A court may increase that amount to as much as $1,500 for a willful or knowing violation. Those are statutory possibilities—not guaranteed payments, settlement values, or legal advice.

Facebook v. Duguid

In 2021, the Supreme Court narrowed the federal definition of an automatic telephone dialing system. A device must use a random or sequential number generator to store or produce telephone numbers. Other TCPA restrictions, including artificial or prerecorded voice rules, require separate analysis.

Why outcomes differ

Consent records, message purpose, technology, exemptions, revocation, caller identity, jurisdiction, and procedural rules can all affect a claim. Regulatory complaints and private lawsuits are different paths, and an agency complaint does not itself pay damages.
